1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the Smelly Candle Co. website and the purchase of products offered by SME Sales Network, LLC, d/b/a Smelly Candle Co., a Delaware Limited Liability Company registered in Massachusetts. By placing an order or using this website, you agree to be bound by these Terms.
2. Products and Pricing
All products are described as accurately as possible, including fragrance notes, wax type, burn time, and vessel size. Prices are listed in U.S. dollars and are subject to change without notice prior to order confirmation. We reserve the right to limit quantities and to cancel any order at our discretion.
3. Order Acceptance
Your receipt of an order confirmation does not constitute our acceptance of an order. We reserve the right to decline any order for any reason, including product availability, errors in pricing, or issues identified by our fraud-prevention measures.
4. Shipping Policy
Orders are processed and shipped within 1–2 business days, excluding weekends and federal holidays. Estimated delivery times vary by destination and shipping method selected at checkout. Smelly Candle Co. is not responsible for carrier delays. Risk of loss and title pass to you upon delivery to the shipping carrier.
5. Refund and Return Policy
Unused, unlighted candles and unopened wax melts and room sprays may be returned within thirty (30) days of delivery for a full refund, less original shipping costs. Candles that have been lit, wax melts that have been melted, and opened room sprays may only be returned if defective or materially different from their description. To initiate a return, contact smellycandles@gmail.com with your order number. Approved refunds are processed within 5–10 business days of receiving the returned item.
6. Damaged or Incorrect Items
If your order arrives damaged or incorrect, please contact us within 7 days of delivery with photographic evidence so that we may arrange a replacement or refund at no additional cost to you.
7. Candle Safety
All candles must be used in accordance with standard candle safety practices: never leave a burning candle unattended; keep away from children, pets, and flammable materials; do not burn for more than 4 hours at a time; trim wick to ¼ inch before each use; and discontinue use when ½ inch of wax remains. Smelly Candle Co. is not liable for injuries, damage, or losses resulting from improper candle use.
8. Fragrance & Scent Disclaimer
Fragrance intensity may vary based on room size, ventilation, burn time, and individual scent sensitivity. Scent Quiz recommendations are for general inspiration only and do not guarantee a specific olfactory experience. Some individuals may be sensitive to fragrance oils; if you have known fragrance sensitivities or allergies, please review ingredient information before purchasing.
9. Intellectual Property
All content on this website is the property of Smelly Candle Co. or its licensors and is protected under applicable U.S. law. No content may be reproduced or used commercially without prior written consent.
10. Limitation of Liability
To the fullest extent permitted by law, Smelly Candle Co. shall not be liable for indirect, incidental, or consequential damages. Our total liability shall not exceed the amount paid for the product giving rise to the claim.
